MICHAEL GEORGE: One of the most frequent questions I get when I hear from clients is what's my case worth, whether it be a medical malpractice case, an automobile accident case, a products liability case. The simple answer to the question is at an early stage I don't know what your case is worth. There are many factors that go into determining what a case is worth in settlement or verdict value.
Many of those factors deal with monetary losses. Have you lost wages? Are you likely to lose wages in the future? Do you have any outstanding medical bills from the treatment from your injuries? These are all factors that have to be considered before trying to determine any sort of settlement value.
The biggest portion of any settlement calculation is obviously what's the human cost to what's happened to you? What are your human damages in pain, in suffering, in embarrassment and humiliation, disfigurement? These are all factors to consider when trying to determine a value of a case.
